“All Rise the Honorable Lorelei Trujillo residing” said the bailiff loudly Nerissa, Gerard, Mikey, Frank and Kelsey all Stood.

“you all maybe seated, now the case at hand the state of New Jersey Vs. Bert Wilbur McCracken.
What Case does the plaintiff bring forth?”

I stood up and looked at my Friend Jeph.
“sir the plaintiff his here with Changes and evidence that the defendant not only broke and entered her house but murdered her brother.”

“call your first witness” stated the judge

“I call to the Stand Gerard Arthur Way”

Gerard Stood up and went up to the stand and placed his hand on the bible.
“sir do you swear to tell the truth the whole truth and nothing but the truth, so help you god” asked the bailiff
“I do” Gerard said Clearly

“Mr.Way, what is your relationship with miss. Johnson?” Jeph asked
“she is my girlfriend” Gerard said
“and what is your relationship with Mr. McCracken?”
“I thought he was my friend”
“did you see the note that was left next to Mr. Johnson’s Body?”
“Yes Sir.”
”thank you that is all” Jeph said sitting down

Bert’s Attorney was next to Question Gerard
“Mr. Way. How was Client to your girlfriend the night he snuck you into the concert?”
“He tried to Rape and kill her”
“Interesting my client states that you swung first Mr. Way is that true?”
“ he was harming her there was no way in hell I was going to stand by and watch him kill the woman I love”

“ I have heard enough No more questions your honor” he said sitting

Gerard stepped down and sat back in his seat.

“would the defendant call their next witness?” the judge called out.

“the defense would like Tessa Menees to the stand”

Tessa walked up and made her vow and told her story
“He abducted me when I was 15 and held me against my will until the day he was arrested.” She said when asked.

“and in those 3 years what do to you?” asked Jeph

“ Raped me several times and in a word tortured me. He used to use a whip on me and left several deep gashed which scared over and dent in. He got me pregnant and when he figured it out he beat me in the stomach until I lost the baby. He sliced my skin in several different places and burned me with candles and cigarettes.” She said crying
“that is ass Miss Menees thank you” Jeph said sitting down.
They all looked at berts attorney.
HE was so not expecting that secret weapon.
“ we have no further questions for miss Menees.”

Tess stepped down and sat next to Kelsey who hugged her.

“would the defence like to call their next witness?”
“we pass to the plaintiffs side your honor”

“your Honor I would like to Call Nerissa Johnson to the stand”

“Miss Johnson, I know this is still fresh but can you tell us what happened the night you found your brother Jack?” Jeph asked sympathetically
“my brother had been depressed about the deah of his boyfriend and had not come out of his room in a couple days so I thought nothing of it till I relized he had not eaten in days.
Then I heard a thump and I ran upstairs and I had to break open the door.
When I did I found my brother in a pool of his own blood. I ran over to him and held him in my arms as any other loving person would when they see someone they love laying there dead.
My Brother had a note on his chest.
Bert called me the same thing the note said the night he tried to rape me. “Little Bitch.” She finished Tearfully.

“that is all thank you miss Johnson.”

“Miss Johnson” started Bert’s Lawyer started
“ did you know my client before the concert?”
“no”
“and can you prove that it was my client that killed your brother?”
“of yeah cause of course I have ESP” she snapped back sarcastically and crying.

“that is all your honor” he said sitting down

“the Defence calls Bert McCracken to the stand”

Bert sat in the stand and smiled evilly at Nerissa and Tessa.
“Mr. McCracken, please tell us of how you know these two women.” His lawyer asked
Bert snarled
“ I did it. I killed that faggot. And I don’t regret it I told you that you would pay you little whore. You pretend to be wholesome and pure. But I know your not.
You think your father’s Death was an accident?
Wrong little girl.
I Hired that truck driver to do that. Your Father is the reason My Career never got off the ground.
I was watching in the woods as daddy’s little girl sat there and cried over her father’s Dying body and I was laughing the whole time.
I swore you would be next.
I promised him that I was going to get to everything he held close to him.
And I have, your father destroyed my life and I am doing the same to you.
How does it feel huh? Does it hurt? I don’t care if I go to Jail.
As long as I get to sit here and watch you loose every little bit of faith that you have.

I killed him because he was in my way. Not just that but because he was gay.” Bert finished laughing cruelly.

Nerissa sat there and held her backbone.
She didn’t Cry, she didn’t twitch or become wide eyed.

The judge banged her gavel.

There will be a 1 hour recess so the jury can process the information they have just obtained.

1 hour later
“We the jury Find Bert Wilbur McCracken guilty of 2 counts 1st degree murder, for the deaths of Jack and Mitchell Johnson.
We the Jury also find Bert Wilbur McCracken guilty of child abduction, rape, and murder of an unborn infant.
We the Jury find Bert Wilbur McCracken Guilty of Human Cruelty. Your Honor”

“please rise. Bert Wilbur McCracken you have been charged with the previous mentioned crimes. I sentence you to 50 life sentences with out the chance of parole. Miss Johnson do you have anything you would like to say to the defendant?”
Nerissa Nodded she stood and looked Directly at Bert and simply said
“ I forgive you. But I will not forget what you have done to my family. Your life is in Gods hands and he will decide what to do with your life.” She replied in a strong seldom voice.
“ Case dimissed”

The guys and Kelsey all jumped up and cheered and hugged each other Jeph walked over and gave Tessa his phone number.
Tessa and everyone came over and hugged Nerissa.
Gerard whispered in her ear
“ we all still love you”
